The testimonial regulation, if you look closely is IMPOSSIBLE to comply with.
It's been written deliberately as a "gotcha".

IE, how do you measure "typical" results??
Is it "Typical" for students who attend 2 classes per week for 3 years........is it "typical" for a student who never practices at home.......is it typical for students who take 3 lessons and drop out?????

There is NO specific definition or "Typical" nor of the steps you must take to comply. As with MANY mis-guided regulatory moves, especially in the last number of months, it's overly broad, general and un-definable.....therefore, you're guilty regardless of what you do.

Yes "Robo Calls" are annoying....but keep in mind that this regulation prohibits them EVEN IF THE CUSTOMER WANTS THEM!!

That's the core issue here......a "blanket" prohibition without concern for legitimate, legal, honest use for businesses that care about and have good relationships with their customers.

Well, in this case you are wrong. I am definitely distrust the government in just about everything. But in these cases, "testimonials" and "robocalls" I think the FTC finally has doe something correctly.

Testimonials that do not represent typical results are the equivalent of lying. Any company that uses them, even with a disclaimer, is clearly attempting to mislead. If you do not understand that then you are just as morally corrupt as them.

Marketing calls are an annoyance and end up costing the caller money. There are plenty of avenues for consumers to get information. There are few things that are as hateful as marketing calls throughout the day. In fact, all marketing calls should be illegal.

Hi Toby,

Thanks for the info - very useful.

It seems to me that the FTC has recently started looking very closely at the whole online marketing industry. They have also made it necessary for people to declare (on websites, blogs, etc) when a review leads via an affiliate link. (Think this comes into force next month).

I don't like government interference (especially for me - being as I'm in England - a foreign government) HOWEVER, I do like the fundamental principles of integrity, openness and honesty (Which I hope that we strive for as individuals and try to teach to our students). So I guess I can't moan too much :)

I hate the recorded - let me sell you something calls and immediately hang up - so for me the pitch never gets through - In England there are not too many of these calls - think it's a mix of regulation and companies simply not finding it an efficient marketing method...

Still there is no doubt that whichever country you live in, if you run a business (especially a small one) you spend half the year watching out for how the government is making life difficult for you and the other half 'working' for the government so you can pay tax, fill out forms and do all the other lovely stuff that governments enjoy throwing our way...

I am not right or left wing, I subscribe to the idea that "It doesn't matter who you vote for, the government always gets in!" ;)

Have fun.
